Medical Malpractice Resources

In December 2004 the MAOFP created an Ad Hoc Committee on Medical Liability which has compiled the following suggestions when seeking to choose the best malpractice insurer to meet your needs. We have also compiled a list of the largest insurers in Michigan to assist you in contacting them. If you have any suggestions on ways in which our committee can work to assist our members in this process please contact our office at: maofp@mi-osteopathic.org.

1) Start early
It will take two to three months to research companies. Collect the necessary historical data and submit applications (which are getting disgustingly detailed). Present this information to company underwriters and get a true quote back.
2) Get all quotes in writing
We are spending a great deal of money for malpractice insurance, we have the right to have information presented to us in a professional manner in which we can compare other programs. Look for hidden extra costs.
3) Explore multiple companies
Consider the company’s fiscal health, on shore versus off shore companies, hospital or group policies, common council requirements, rights to settle a physicians or companies choice? Look at portability and regional differences (what works in rural areas will not always work in metro areas).
4) Evaluate critically what you do
Minor surgery rates cost you between $4,000 and $10,000 in premiums. Look at what those procedures generate in income and evaluate whether they are profitable to you or not.
5) Move to a new insurer only if it makes financial sense
If you have claims made insurance and are one or two years from retirement and have been with a company for greater than five years, the tail is likely to be covered. If you leave you will be stuck practicing for five more years or have to pay for a tail.
6) Determine what kind of policy you want (or can afford)
Claims made, modified claims made or occurrence.
7) Talk with your colleagues
Too long physicians have been private about what they pay for malpractice, but communication with your friends can save you thousands of dollars.
